Terms and Conditions of Sale – Cognac Select

1. Purpose

These Terms and Conditions of Sale govern all purchases made on the website Cognac Select (the “Website”) by any customer (the “Customer”).
By placing an order on the Website, the Customer fully accepts these Terms without reservation.

2. Products

Cognac Select offers for sale spirits and related products, primarily alcoholic beverages.
Product descriptions, photographs, and information are provided for indicative purposes only and do not constitute a contractual guarantee.

3. Eligibility

The purchase of alcoholic beverages is strictly reserved for persons of legal drinking age in their country of residence.
By placing an order, the Customer confirms that they meet this legal requirement.

4. Prices

All prices displayed on the Website are in euros (€) and include applicable taxes, unless otherwise stated.
Shipping costs, customs duties, and local taxes (where applicable) are not included and are indicated separately before order confirmation.

Cognac Select reserves the right to modify prices at any time. The price charged will be the one in effect at the time of order confirmation.

5. Orders

Orders are placed online via the Website.
Once the order is confirmed and payment validated, the Customer will receive an order confirmation email.

Cognac Select reserves the right to refuse or cancel any order in the event of payment issues, suspected fraud, or non-compliance with these Terms.

6. Payment

Payment is due in full at the time of order.
Accepted payment methods are those displayed on the Website at checkout.

All transactions are secured using industry-standard encryption technologies.

7. Shipping and Delivery

Orders are shipped in accordance with the Shipping Policy available on the Website.

Delivery times are indicative and may vary depending on destination, carrier, and customs procedures.
Cognac Select cannot be held responsible for delays caused by carriers or customs authorities.

8. Customs Duties and Import Regulations

For deliveries outside the European Union, customs duties, import taxes, or additional fees may be required by the destination country.
These costs are entirely borne by the Customer.

The Customer is responsible for ensuring that the ordered products may be legally imported into their country.

9. Right of Withdrawal

In accordance with applicable regulations, the right of withdrawal does not apply to:

• sealed products that cannot be returned for health or hygiene reasons once opened,

• alcoholic beverages whose price depends on market fluctuations beyond the seller’s control.

If a right of withdrawal applies, the Customer must notify Cognac Select in writing within the legal timeframe.

10. Returns and Claims

Products must be checked upon receipt.
Any claim regarding damaged, missing, or non-conforming products must be reported within 48 hours of delivery, accompanied by photos and supporting evidence.

No return will be accepted without prior written agreement from Cognac Select.

11. Liability

Cognac Select shall not be held liable for indirect damages resulting from the use of the products sold.
Total liability, if applicable, shall in all cases be limited to the amount of the order concerned.

12. Force Majeure

Cognac Select shall not be held liable for failure or delay in performance caused by events beyond its reasonable control (force majeure), including but not limited to strikes, natural disasters, transport disruptions, or governmental actions.

13. Intellectual Property

All content on the Website (texts, images, logos, trademarks) is the exclusive property of Cognac Select and may not be reproduced or used without prior written authorization.

14. Governing Law

These Terms and Conditions are governed by French law.

15. Disputes

In the event of a dispute, the parties will seek an amicable solution before initiating legal proceedings.
Failing such resolution, the competent courts shall be those of France, unless mandatory consumer protection rules provide otherwise.
